It is a law which aimed at addressing legal issues concerning online interactions and the Internet in the Philippines.

The first law in the Philippines that criminalizes computer crime such as cybersquatting, cybersex, child pornography, identity theft, illegal access to data and libel.

The willful engagement, maintenance, control, or operation, directly or indirectly, of any lascivious exhibition of sexual organs or sexual activity, with the aid of a computer system for favor or consideration.

The unlawful or prohibited acts defined and punishable by RA 9775 or the Anti-child Pornography Act of 2009 committed through a computer system.

The penalty to be imposed shall be (1) one degree higher than that provided for in RA 9775

The transmission of commercial electronic communications with the use of computer system which seek to advertise, sell, or offer for sale products and services is prohibited.

The unlawful or prohibited acts of libel as defined in Article 355 of the Revised Penal Code, as amended, committed through a computer system or any other similar means which may be devised in the future.

Government Agencies enforcing and implementing the law:

Responsible of implementing the provisions of the law.

Responsible for assisting in investigations or proceedings concerning criminal offenses related to computer system or data.

It includes the following: publication, exhibition, cinematography, indecent show, information technology, or any representationof a person engaged in real or simulated sexual activities. It also includes any representation of the sexual parts of a person primarily for sexual excitement.

This includes the use of a child in pornographic performances and materials.

It also covers situations where a child is forced to do pornographic acts.

This law was created to promote public awareness about the following issues related about HIV/AIDS:

HIV/AIDS

It is a condition by a combination of signs and symptoms, caused by HIV contracted from another person.

To hire, employ, use, persuade, induce, or coerce a child to perform in the creation or production of any form of child pornography.

To produce, direct, manufacture, or create any form of child pornography.

To publish, offer, transmit, sell, distribute, broadcast, advertise, promote, export or import any form of child pornography.

To possess any form of child pornography with the intent to sell, distribute, publish, or broadcast: Provided that possession of three or more articles of child pornography of the same form shall be prima facie evidence of the intent to sell, distribute, publish, or broadcast;

The state recognizes the vital role of the youth in nation building.

Thus, it shall promote the welfare of children and protect them from physical, emotional, moral and spiritual harm and injury.

The DepEd and other government agencies should work hand-in-hand so that information on AIDS are included in the classroom.

All teachers and instructors of said HIV/AIDS should undergo a seminar or training on HIV/AIDS prevention and control to be supervised by DepEd, CHED and TESDA, in coordination with the Department of Health (DOH), before they are allowed to teach the subject.
