The hospitality and tourism industry a worldwide income generating activity that has several direct and indirect business relationships and as such contracts between the industry and its suppliers and clients are entered into in a daily basis. As a future tourism practitioner, a basic knowledge of contracts would be an advantage.

Contract, as defined, is a meeting of the minds between two persons, whereby one binds himself, with respect to another , to give something or render some service. (Art. 1305 of the NCC)

As a general rule, a contract shall be obligatory in any form, thus it can be made orally and in writing

1. Mutuality of contract - it must be based on the will of all parties (see Art. 1308 of the NCC) 2. Autonomy of contract - the parties may provide any terms and conditions they deemed fit provided that they are not contrary to law, morals, good customs, public policy, or public order (see Art. 1306 of the NCC) 3. Obligatory force - once the contract is pertected the parties must faithfully observe the terms and conditions of the contract. (see Art. 1315 of the NCC) 4. Relativity of contract - the contract entered into by the parties are only bondingon oite, chir hels are no sins nice by their nature, by stipulations of the party, or by law. (see Art. 1311 of the NCC)
